Agreement to Terms

By accessing or using Weather Alert Philippines ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Description of Service

Weather Alert Philippines provides weather information, typhoon tracking, forecasts, and related educational content for the Philippines region. The Service aggregates data from third-party sources including OpenWeatherMap, RainViewer, and public historical records. We are an independent service and are not affiliated with any government agency.

Weather Alert Philippines provides weather information for informational purposes only. While we strive to provide accurate and up-to-date information, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the weather data, forecasts, or related information provided through the Service.

Not Official Weather Service

IMPORTANT: Weather Alert Philippines is NOT an official government weather service. For official weather warnings, advisories, and emergency information, always consult the Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA) at www.pagasa.dost.gov.ph.

Use at Your Own Risk

Any reliance you place on weather information provided by the Service is strictly at your own risk. We shall not be liable for any loss or damage arising from your use of or reliance on weather information provided through the Service.

Limitation of Liability

In no event shall Weather Alert Philippines, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Errors, inaccuracies, or delays in weather information
• Decisions made based on weather information provided by the Service

Indemnification

You agree to defend, indemnify, and hold harmless Weather Alert Philippines and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or a breach of these Terms.

User Responsibilities

Appropriate Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate Weather Alert Philippines, an employee, another user, or any other person or entity
• In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service

Emergency Situations

DO NOT rely solely on this Service for emergency weather decisions. In case of severe weather or emergency situations, always follow official government advisories and evacuation orders from PAGASA and local authorities.

Intellectual Property

The Service and its original content (excluding weather data from third-party sources), features, and functionality are and will remain the exclusive property of Weather Alert Philippines. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Weather data is provided by third-party services (OpenWeatherMap, RainViewer) and is subject to their respective terms and licenses. Historical typhoon data is derived from public records.

Third-Party Links

Our Service may contain links to third-party websites or services that are not owned or controlled by Weather Alert Philippines. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Weather Alert Philippines shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.

Data Sources and Attribution

Weather Alert Philippines uses the following data sources:

• OpenWeatherMap: Current weather conditions and forecasts
• RainViewer: Weather radar imagery
• Public Records: Historical typhoon data and statistics

All data is used in accordance with the respective providers' terms of service and licenses.

Modifications to Service

We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Service is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Service, or the entire Service, to users.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.
